Service means the mod.io website, the API, SDK, official engine plugins and apps and related internet services operated by DBolical Pty Ltd.

We consider games, mods, mod files, articles, comments and forum posts you share, reply to, comment on, or contribute to publicly, to be Public Data.

Means DBolical Pty Ltd and any parent, subsidiary, affiliated or related companies, without limitation.

Usage Data is data collected automatically either generated by the use of the Service or from the Service infrastructure itself (e.g. the duration of a page visit).
Cookies are small pieces of data stored on your device (computer or mobile device).

With the exception of your API key, payment details and agreements associated with Public Data (which will remain private), our Service is designed to make this information available to third-party sites, services, games, applications and users that consume our API ("Developers").
If you believe your Personal Data has been shared within Public Data and you do not have access to amend or remove it, contact us and we will resolve your concern.
We may also collect information automatically that your browser sends us whenever you visit our Service, when you access the Service by or through a mobile device, or when you access the Service by or through a game or application that implements our API ("Usage Data").
This Usage Data may include information such as your computer's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
When you access the Service by or through a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.
When you access the Service by or through a game or application that implements our API, this Usage Data may include information such as the game or application you are running, your operating system, your IP address and other diagnostic data.
Tracking & Cookies Data
Cookies are files with small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Tracking technologies also used are beacons, tags, and scripts to collect and track information and to improve and analyze our Service.

DBolical Pty Ltd and its subsidiaries and affiliates (the "Related Companies") use the collected data for various legitimate purposes:
- To provide and maintain our Service;
- To notify you about changes to our Service;
- To allow you to participate in interactive features of our Service when you actively choose to do so (e.g. our primary purpose is to manage your mod collection in games you play);
- To customize your experience on our Service (e.g. recommend mods and games that we think may interest you based on your previous use);

- To gather analysis or valuable information so that we can improve the quality of our Service;
- To monitor the usage of our Service;
- To detect, prevent and address technical issues (such as bug fixes); and
- To provide you with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information.
We are not a marketing company. Under no circumstances do we rent or share your Personal Data with marketing companies and advertising providers.
How You Use Your Data
Please remember that any information you publish or otherwise communicate via DBolical Pty Ltd Services (e.g. private messages, comments, forum posts, reviews, articles, subscriptions or media) may reveal personally identifiable information, such as your screen name, and other details about you, and the content of any communications by you with other users. Also, Public Data you share using DBolical Pty Ltd Services (e.g. your public profile, games, mods and mod files) will be publicly available to Service users, Developers and others. We are not responsible private personal information, which you choose to make publicly available via DBolical Pty Ltd Services, or the activities of other users, or other third-parties to whom you give or make available your data.
Legal Basis for Processing Personal Data Under General Data Protection Regulation (GDPR)
DBolical Pty Ltd may process your Personal Data because it has a legitimate interest in that data, such as in each of the following cases:
- We need to perform a contract with you;
- You have given us permission to do so;
- For payment processing purposes (e.g. tax laws require us to retain records of payments made through our Service); and
- To comply with any applicable law.
Retention of Data
DBolical Pty Ltd will retain Personal Data for so long as it may be relevant to the purposes identified herein, and your account remains active. To dispose of Personal Data, we may anonymize it, delete it or take other appropriate steps. Data may persist in copies made for backup and business continuity purposes for additional time.
DBolical Pty Ltd will also retain Public Data which has been accessed or used by third-party services and sites. To dispose of Public Data, we may anonymize it, delete it or take other appropriate steps, which will make this information non-personally identifiable. Data may persist in copies made for backup, by third-parties and business continuity purposes for additional time.
DBolical Pty Ltd will also retain Usage Data for internal service improvement purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.
Transfer of Data
Your information, including Personal Data, may be transferred to - and maintained on - computers located outside of your jurisdiction where the data protection laws may differ than those from your jurisdiction.
If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to the United States and process it there.

Developers using our API will have access to Public Data you have shared or contributed too. Developers must use such information only to provide the API functionality within their games, sites, applications and/or services.
Disclosure for Law Enforcement
Under certain circumstances, DBolical Pty Ltd may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency). We respond to such requests, wherever required to do so.
Agents, Consultants and Related Third-Parties
Under certain circumstances, DBolical Pty Ltd may hire other companies or individuals to perform certain business-related functions. Examples of such functions include mailing information, maintaining databases, backups and processing payments.
DBolical Pty Ltd may disclose your Personal Data in the good faith belief that such action is necessary to:
- To comply with a legal obligation;
- To protect and defend the rights or property of DBolical Pty Ltd;
- To prevent or investigate possible wrongdoing in connection with the Service;

- The right to withdraw consent. You also have the right to withdraw your consent at any time where DBolical Pty Ltd relied on your consent to process your personal information.

You have the right to complain to a Data Protection Authority about our collection and use of your Personal Data. However, we encourage you to contact us first, and we will do our very best to resolve your concern.
We may employ third-party companies and individuals to facilitate our Service ("Service Providers"), to provide the Service on our behalf, to perform Service-related services or to assist us in analyzing how our Service is used.
These third-parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

- Google Analytics
Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. - Stop Forum Spam
Stop Forum Spam is an anti-spam service used to confirm bad actors. In the event we believe a user is a spammer (less than 1% of cases), we may cross-check the users email and IP address with the Stop Forum Spam database, to determine if this is the case. We may use third-party Service Providers to backup, store and transfer data.
- Amazon AWS
We may provide paid products and/or services within the Service. In that case, we use third-party services for payment processing (e.g. payment processors).
- PayPal or Braintree
We occasionally embed social media widgets, to allow our community to share and promote content posted on our Service. Your use of these features enables the sharing of certain information with your friends or the public, depending on the settings you establish with the third-party that provides the social sharing feature. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.
Our Service is for users age 13 and over and we do not knowingly collect personal information from children under the age of 13. If you are a parent or guardian of a child under the age of 13 and believe he or she has disclosed personal information to us please contact us, and we will take reasonable measures to promptly remove applicable information from our records immediately. For residents of the EEA, where processing of personal information is based on consent, DBolical Pty Ltd will not knowingly engage in that processing for users under the age of consent established by applicable data protection law. If we learn that we are engaged in that processing with such users, we will halt such processing and will take reasonable measures to promptly remove applicable information from our records.
